  • Create modified versions (including accurate reproductions) for personal projects

  • Share process work, screenshots, and comparisons online
  • 3D print for personal use (not for sale)

PROHIBITED:

  • Any commercial use without written permission (no selling, no client work, no monetized projects)
  • AI/ML training or any computational AI use (including non-commercial)
  • Reselling or redistributing the original files
  • Facial recognition, biometric ID, or surveillance systems
  • Illegal, explicit, or harmful content

This is a simplified summary only. The full Terms below are legally binding.

Introduction

These Terms of Service ("Terms") govern your access to and use of the 3D photogrammetry scan files and related assets (each a "Asset", collectively "Assets") provided by Andrii Sybiriakov ("Provider", "we", or "us"). By accessing, downloading, or using any Asset, you ("User" or "you") agree to these Terms.

1. Definitions

"Reference Use" — use of a Provider Material solely as a visual or study reference for creating new works (e.g., study, concept art, sculpting reference, texture reference).

"Derivative Work" — a work based upon a Asset in which the Asset is recast, transformed, adapted, or incorporated into a new creative work.

"Digital Double" — any 3D model, mesh, texture set, or digital reproduction that reproduces the geometry, proportions, textures, or identifying details of the original Asset to a degree that is substantially similar to the original.

"Accurate Reproduction" — any physical or digital reproduction that closely replicates the original Asset's appearance, structure, or identifying characteristics.

"Substantially Similar" — having the same or nearly identical geometric structure, proportions, facial features, or other identifying characteristics that would make the reproduction recognizable as being derived from the original Asset.

"Commercial Use" — use of a Asset or derivative work in any business, commercial, or for-profit context, including but not limited to advertising, marketing, sales, or professional services.

"Assets" – the original 3D models (.obj, .fbx, .blend, etc.), textures (.png, .jpg, .exr, etc.), photos, reference videos, scripts, and any other digital assets, documentation, or materials included with the download.

2. Grant of License

Subject to these Terms, Provider grants you a non-exclusive, royalty-free, worldwide license to use the Assets for Reference Use and for creating derivative works, including Digital Doubles and Accurate Reproductions, for personal, educational, or other non-commercial projects only.

All rights not expressly granted in these Terms are reserved by Provider, 
including without limitation any rights to use the Assets for AI/ML purposes.

3. Permitted Uses

You may use the Assets for:

  • Reference material for creating original sculptures, digital art, models, textures, or other creative works.
  • Study, research, and educational purposes.
  • Creating Digital Doubles or Accurate Reproductions of the Assets for non-commercial purposes, including but not limited to study, practice (e.g., retopology, texture projection), and inclusion in personal portfolio projects.
  • Sharing with assistants, collaborators, or students working under your supervision on your projects (provided they follow these Terms).
  • Publishing your original works online that were created using Assets as reference material.
  • Sharing screenshots, images, or portions of Assets online for comparison, process documentation, tutorials, or educational purposes in connection with your original work.

4. Prohibited Uses

Prohibited uses include, but are not limited to:

  • Using the Assets or any Derivative Work in any business, for-profit, or commercial context ("Commercial Use") without explicit written permission from the Provider...
  • Directly copying, reproducing, or redistributing the Asset files for resale, licensing, or public distribution.
  • Creating, selling, licensing, or distributing Digital Doubles or Accurate Reproductions of the Assets for any Commercial Use.
  • Using the Assets or any Derivative Work to train, validate, or fine-tune 
    machine learning models, neural networks, or generative AI systems without explicit written permission from Provider. Explicit written permission must be provided via a signed written agreement or an email from info@scansoup.com that specifically authorizes the requested AI/ML use case.
    This prohibition applies regardless of whether the AI use is commercial or non-commercial, and regardless of whether the Assets are used directly or after transformation, processing, or conversion to other formats.
    This prohibition includes:
    • Use in training datasets or dataset derivatives
    • Embedding generation or feature extraction
    • eriving model weights or checkpoints from the Assets or Derivative Works
    • Synthetic data generation based on the Assets or Derivative Works
    • Any computational use that creates, modifies, or enhances AI model parameters or outputs
    • Inference, queries, or prompts using pre-trained AI models (including but not limited to using Assets as input to image generation, 3D generation, or 
      text-to-image systems)
    • Use of Assets to generate, enhance, or validate AI-generated outputs (including but not limited to images, 3D models, textures, or animations)
    • Incorporation of Assets into vector databases, retrieval systems, or AI knowledge bases
    • Use of Assets for benchmarking, testing, or evaluating AI model performance
    • Transfer learning or domain adaptation using the Assets
    • Data mining, automated analysis, or computational processing for AI/ML purposes
    • Using information derived from the Assets (including descriptions, measurements, metadata, or statistical parameters) as input to any AI/ML system
  • Using the Assets or any Derivative Work to enable facial recognition, biometric identification, surveillance, or other privacy-invasive systems.
  • Using Assets for pornographic, sexually explicit, exploitative, illegal, hateful, terrorist, or otherwise unlawful content.
  • Using Assets for medical diagnosis, treatment planning, or other regulated medical purposes without a separate agreement.
  • Claiming ownership of the original Asset files or presenting the original Asset as your own work.
  • Any use that violates applicable laws or the rights of third parties.

5. Model Releases & Consent

Provider represents and warrants that Provider has obtained the necessary model releases and consents from the individuals depicted in the Assets, permitting their distribution and use under the non-commercial terms described herein.

Model release documentation is retained by Provider. If a model's consent is withdrawn after distribution, Provider will make reasonable efforts to notify Users and cease future distribution, but cannot recall Assets already downloaded.

In such cases, Users should cease prominent public display of the affected Asset but may continue non-public use (e.g., study, private reference) under these Terms.

6. Physical Reproduction & 3D Printing

You may create physical reproductions (including 3D prints) of the Assets or your derivative works for personal, non-commercial purposes (e.g., for study or as a physical sculpture for your portfolio or home). Commercial production, sale, or distribution of any physical reproduction is strictly prohibited.

7. Attribution

Attribution not required but strongly encouraged for portfolio/public work. Suggested attribution formats (when practical):

8. Intellectual Property Rights

All rights, title, and interest in the original Asset files and Assets remain with Provider. This license grants only the limited usage rights set forth in these Terms; it does not transfer ownership.

9. No Warranties

Assets are provided "as is", without warranties of any kind, whether express or implied. Provider makes no representations or warranties as to accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement.

10. Limitation of Liability

Assets are provided free of charge. To the maximum extent permitted by Ukrainian law, Provider's total liability for any claim arising from or related to the Assets or these Terms shall not exceed USD 100 (one hundred US dollars) or the amount you paid for the Asset, whichever is greater.

Provider shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages.

Nothing in these Terms excludes liability for fraud, willful misconduct, or violations of mandatory consumer protection rights under Ukrainian law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Provider and its officers, agents, and employees from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with your breach of these Terms or your use of the Assets.

12. Termination; Effect on Existing Works

Provider may terminate or suspend access to future downloads at any time. Termination or suspension does not affect any rights you already used or exercised prior to termination. Uses and works created and distributed by you prior to termination remain licensed on an irrevocable basis so long as they comply with these Terms.

13. Reporting Misuse

To report suspected copyright infringement, misuse of Assets, or other violations, contact info@scansoup.com with details. Provider may investigate and suspend access or take other actions as necessary.

14. Privacy; Logs and Records

Provider logs download activity (including timestamp and download link identifiers) based on legitimate interest in tracking distribution and preventing misuse.

When Assets are distributed via email-based links, Provider collects and logs email addresses with your consent (provided when you request the download link) for distribution tracking and communication purposes only.

Email addresses and logs are retained for 24 months from last download activity, after which they are deleted. You have the right to request access to, correction of, or deletion of your data by contacting info@scansoup.com.

Provider will process personal data in accordance with GDPR and applicable data protection laws. If you are subject to GDPR or similar laws, ensure you have any required rights/consents prior to using these Assets.

15. Age Restriction

By downloading or using the Assets you confirm that you are at least 18 years old or have parental/guardian consent to use the Assets under these Terms.

16. No Endorsement

Use of Assets does not imply Provider's endorsement of your projects. You may not state or imply Provider's endorsement without Provider's express written consent.

17. Changes to Terms

Provider may update these Terms from time to time. The Effective Date and Version number at the top will be updated for new versions. 
The version of the Terms in effect at the time of your download governs your use of that specific Asset permanently. Changes do not apply retroactively to Assets already downloaded or works already created under prior versions.

New downloads after an update will require re-acceptance of the updated Terms and will be governed by the new version.

18. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Ukraine. Any disputes arising out of or relating to these Terms shall be subject to the jurisdiction of the courts located in Kyiv, Ukraine (unless the parties agree otherwise in writing).

19. Requests for Additional Rights

To request additional rights (for example: permission to create Accurate Reproductions, permission to use Assets for AI/ML training, sublicensing, or sale of derived assets), email info@scansoup.com with a detailed description of the intended use and any proposed compensation or terms. Provider will review requests and respond in a reasonable time.

20. Miscellaneous

Entire Agreement. These Terms constitute the entire agreement between you and Provider regarding the Assets. Severability. If any provision is found unenforceable, the remaining provisions remain in effect. Waiver. Provider's failure to enforce any provision is not a waiver of future enforcement rights.

21. Download Access & Technical Issues

Download links are provided on a time-limited basis as specified in the distribution email or download page. Provider is not responsible for failed downloads due to network issues, browser problems, or user error. Users are responsible for completing downloads within the access period. Acceptance

By clicking "I have read and agree" in the download interface, downloading, or using any Asset, you confirm that you have read, understood, and agree to be bound by these Terms. A copy of these Terms is included with each Asset download and is available at https://scansoup.com/en/terms. Downloads without accepting these Terms are unauthorized.
